This statement describes what Upside Energy Pty Ltd (ACN 697 781 650) collects through this website, how we use it, who else receives it, and how to access or delete it. It applies to this website. A signed roof lease is governed by its own terms.

We collect your email address, and optionally your postcode, roof size and phone number, when you submit one of the two forms on this site. We use these details to respond to your enquiry. We do not sell, rent or trade personal information. We do not operate a marketing list. This site sets no cookies and carries no advertising trackers.
Two forms on this site submit information to us: the estimate calculator and the enquiry form. Between them they collect four items.
We do not ask for your name, your address, details of your tenants, or information about your energy use. The forms do not identify the building beyond its postcode.
Each submission also records the IP address the request came from and the browser user agent string. Both are included at the foot of the notification email we receive. We use them to identify automated and bulk submissions.
We use your details to respond to your enquiry about your roof. We do not build a profile from them, score them, or combine them with information from other sources.
We do not operate a mailing list. Submitting an enquiry does not add you to a marketing list. If we start one, we will ask you to opt in first.
You do not have to use the forms. You can email us or call instead.
Three service providers handle information submitted through this site. We do not authorise any of them to use personal information for their own purposes.
Apart from these providers, we disclose personal information only where the law requires it or where you ask us to.
Resend, Vercel and Upstash are United States companies and may store or process data outside Australia. Information held outside Australia is subject to the laws of the country in which it is held.
This site sets no cookies and stores nothing in your browser.
We use Vercel Analytics to measure how the site is used. It sets no cookies and does not track you across other sites. It records page views, which include the page address, the site you arrived from, your browser, your device type and your country. It also records three events: use of the calculator, a click on our phone number or email address, and a form submission. The form submission event records which form was used, and the roof size as a size band such as 1k-2.5k or over-10k. It does not record the figure you entered. Email addresses, phone numbers and postcodes are never sent to analytics.
Fonts are served from our own domain. This page requests no fonts or stylesheets from Google or any other third party.
Enquiries reach us as email and remain in our mailbox. We keep them while we are in contact with you about your roof, and afterwards for as long as we are required to keep business records. You can ask us to delete your enquiry at any time.
The rate limiting counter expires approximately sixty seconds after a submission. Server logs at Vercel are retained on that provider’s schedule. Analytics data is aggregated and does not identify you.
The site is served over HTTPS. Form submissions are validated on the server as well as in your browser. Credentials for the services listed above are held as deployment secrets and are not stored in our code. The information we hold is limited to what you submit through a form.
Email ben@upsideenergy.com.au to request a copy of the information we hold about you, to correct information that is wrong, or to have it deleted. There is no charge. We aim to respond within 30 days, and we will tell you if a request will take longer.
Where your enquiry forms part of a lease negotiation, company and tax law require us to retain the record for a set period. In that case we will tell you what we are required to retain and for how long, delete the remainder, and use the retained information only for the purpose that requires us to keep it.
The Privacy Act 1988 (Cth) applies to businesses with an annual turnover above $3 million. Upside Energy is below that threshold, so the Act does not currently bind us, and the Australian Privacy Principles are not a legal obligation we carry.
We apply the Australian Privacy Principles as our own standard. If our turnover passes the threshold, the Act will apply automatically.
Two limits on this exemption apply regardless of our size. Since 10 June 2025, an individual may bring a court action against any business for a serious invasion of privacy. The exemption is also conditional: a business that trades in personal information is covered by the Act whatever its turnover. We do not trade in personal information.

The Office of the Australian Information Commissioner can investigate complaints only about businesses the Privacy Act covers. It cannot investigate a complaint about Upside Energy while we are below the turnover threshold. If our response does not resolve your complaint, your remaining options are a claim under Australian Consumer Law in respect of a statement made on this page, or a court action for serious invasion of privacy.
If what we collect or how we use it changes, we will update this page and change the date shown above. We will not extend how we use details you have already given us without telling you.
